shut down from stouffer to the entrance to the plant shopping center. that's about three block distance. it is not shot down at kurtner and tully. that intersection is opening. i will take it from here. new video of a fire overnight in alameda. you can see the flames and smoke coming from the roof of this building on park street. the building houses businesses on the ground level and several apartments above it. joining us live on the phone is captain colburn. what can you tell us about this fire? is it out at this point? >> no, it is still a working fire. firefighters have pulled out of the building and your fighting it in defensive fashion with a hose line and ladder. >> we said there are apartments

above. people being ewaited. any injuries so far? >> no reported injuries to firefighters or civilians. >> are evacuations in place there? >> people were evacuated from the building that actually burned t was a three-story building with businesses on the first floor and apartments above. the fire is still active on the second and third floors of the building. >> i understand this is a two-alarm and we are getting a good look at the scene right here. any idea about damage. it looks pretty severe. >> i don't have a map for you but i understand the second and third floors are heavily damaged with fire. the first floor has not had fire damage but it is sustaining quite a bit of water damage. the fire has been contained to the one building. >> well, that's good news there. you mentioned that the firefighters had to pull out. is this building at risk of collapsing? >> yeah. there is concern because of the amount of damage to the building from the fire. so firefighters have pulled out

"today in the bay's" christie smith joins us live in san francisco with more. good morning, christie. >> reporter: couples here in the bay area and those that hopped a plane to view this say it feels like a day in history. hundreds of marriage equality supporters rallied at san francisco city hall urging the u.s. supreme court to rule in favor of marriage equality as it

considers california's same-sex marriage ban, prop 8, a march from the district covered two city blocks, couples telling stories of getting married in 2004 and then seeing it voided and try tog get married again in 2008. one couple together for 21 years told us they want the justices to see that they should be treated equally upped the law. >> if i'm in the hospital and i got the wrong nurse, they won't let him in. we want it to pass to give us the kind of relates we deserve. >> in washington, d.c., people are camped out hoping for a chance to hear the argument in person. opponents of same-sex marriage are represented there too. wednesday, the court will take up the federal defense of marriage act that defines marriage as between one man and one woman. in oakland and berkeley, they will be flying the rainbow flag at the respective city halls. there are also a number of vigils going on at the state

building here in san francisco both tonight and tomorrow night. reporting live, kristy myth. our coverage of the prop 8 argument continues throughout the morning. coming up at 5:40, we will go live outside the court where people are paying thousands just to get inside. we will cover this story all morning long online at nbcbayarea.com. breaking news from overseas where italy's highest criminal court has ordered an appeals court to rehear the murder case involving amanda knox and her ex-boyfriend. arturo santiago is live in our newsroom with details. good morning. >> good morning, marla. we will let others decide if the timing of this court decision is good or bad for amanda knox. she is about to make her first public appearance on tv next month when her book comes out. a new trial is something she was hoping would not happen. it was back in 2007 that amanda

knox and her then boyfriend were accused of killing meredith kercher in italy. the trial grabbed headlines all over the world. the two were found guilty and knox was sentenced to 26 years in prison. in 2011 after serving four years, their convictions were overturned because of numerous errors that were made during the investigation. amanda knox and raffaele sollecito were released. last year, prosecutors found the motion appealing those acquittals, called the ver dibltverdikts illegal. they looked at if there were procedural irregularities that would give grounds for a new trial but did not examine details of the case itself. the court's reason force a new trial will be announced later. amanda knox released a statement in part which says, no matter what happens, my family and i will face this continuing legal battle as we always have, confident in the truth and with

our heads held high in the face of wrongful accusations and unreasonable adversity. that's an end of quote. even though the court has ordered a new trial, italian law cannot force amanda knox to return to italy. her attorney says, if she is convicted and if the conviction is upheld by the highest court, then italy could try to extradite her. i am arturo santiago, "today in the bay." one of amanda knox's attorneys is going to be on the "today" show coming up. it is 5:08 right now. following the forecast for us, meteorologist, christina loren. >> the forecast kind of taking me all over the place for the past couple of days. it has really been one of those forecasts where meteorologists all across the bay area are trying to wrap their brain around when the rain showers will fall and where. it is really difficult. for today, watch out for some patchy fog on your way to work. 49 to start in san jose. 47, concord. 46, good morning to you, up in napa. these numbers are going to come in and out.

these are visibility readings. right now, we are looking okay at the immediate surface. your futurecast tells the story. watch out for a little drizzle. we are picking that up between now and 6:30. 7:00 to 9:00, that fog becomes the most widespread across the bay area. by 11:00, we will see the sun breakthrough the clouds, still a soupy pattern, not full sunshine for today. similar to where we ended up yesterday. basically, a repeat performance. 68 for gilroy, 66 in los gatos and 60 at the immediate coast. ocean beach, comfortable conditions if you want to head out there. a little bit gray but not too bad to watch the waves roll in. the next couple of days, changing on the way. a traffic tuesday. let's get to that with mike inouye. right now, a clear view across the san mateo bridge. as christina said, things could change over the morning's commute. that fog may roll in in many spots. so far, 92 not a problem even though we had that hazard. the slowing earlier has now completely cleared from that

interchange. we will look out well to the maps. south 101 showed some slowing coming out of palo alto. maybe some road crew equipment cleared from the area. it is cleared again as they are getting read did i to clear 101. the crash at matilda has cleared out of the roadways. they were unable to locate any other issues reported. we should have a smooth drive as we see right now. here is where bob is reporting. approaching kurtner and tully. we have that overnight investigation that continues there. they are closing southbound monterrey. kurtner is opened. we will end with another quick look out there. at oakland, 880 moves smoothly. it is 5:10. facebook isn't his only passion. mark zuckerberg is taking on something else with major global impact. a kid sells his start-up to yahoo! for millions of dollars for something else. we'll take a look.

it's 5:13. facebook mark zuckerberg is pushing for immigration reform. he has joined to get more visas for high-tech workers. he has formed a new issues advocacy group which promotes immigration reform, education and other policies aimed at growing the economy. several high-profile consultants have joined. people involved say zuckerberg's interest is broader and includes citizenship for those here illegally. zuckerberg is unusual in that he is an american entrepreneur born in america. it shows how important immigrants are to high-tech. >> you look at the companies within say a 20-mile radius of facebook. google started by a russian. founder of yahoo! in taiwan. intel, hungarian. south african. a majority of people in silicon

valley who have college degrees aren't from this country. speaking of facebook, the securities and exchange commission has given the go-ahead for the nasdaq to face $62 million in restitution to make up for the botched facebook i.p.o. a small amount. most trading houses lost far more than that each when facebook came to market last may. a computer glitch delayed trading, left investors confused about how many shares they had and at what price. speaking of confusion, cyprus is rattling the markets a bit. let's turn to courtney reagan. she is live at cnbc world headquarters. good morning, courtney. >> good morning, scott. futures are higher after a roller coaster day. markets driven by news out of cyprus and everything that's surrounding the country's bailout. the dow had been up as much as 51 points. the s&p 500 came within a quarter of a point of its all-time closing high but failed

county as we head through the second half of today. better chance for rain as we wake up and meet back here on thursday. in fact, thursday is going to be the most active for the week. nonetheless, you might be using your windshield wipers any time between now and thursday with some pretty low cloud cover. thick clouds generating a steady drizzle. we stop that clock between 6:00 and noon. we get showers in san jose. we need the rain at this point. we are going to measure a quarter of an inch, more like a tenth of an inch at best. we need it. 64 for livermore. 65 for fremont. looking good there. temperatures are going to be mild. then, we are going to see a little bit of a warmup tomorrow into thursday. we hit 70 on friday with that chance of showers remaining. saturday and sunday, when we have a better chance, it looks like, between sunday morning and mid-morning. so early hours, between about 4:00 a.m. and 10:00 a.m. that's when we're expecting our showers on easter sunday. things could change. right now, that's the time frame. we'll let you know when things

happen. this is real tough. let's see how tough that drive is shaping up or not. >> good morning. right now, it is the or not. traffic tuesday is also the case. we are tracking this. i turned the camera. interesting view of our bay bridge toll plaza. you see a couple of cars waiting in these lanes, a couple over here. the fast-track lanes. no delays to speak of over here at the bay bridge toll plaza. good flow of traffic down the east shore freeway as well. reports of some debris around the maze. sounds like as you are coming away from the maze, off the direction from the berkeley curve. no delays coming out here including coming off of the caldecott tunnel. marla talked to the fire department over there over at alameda. bridges over there getting to and from oakland. we have park street here. the fire reported way down here. this is not affecting as you cross over to or from the oakland and alameda area. we are following that fire as well. meanwhile, we'll look at the

roadways. your main commute coming through the tri-valley, moving very smoothly right now. east coming out of castro valley. you see the early slowdown off of the dublin grade we often see. that should clear up. this is just starting to build here. highway 84 down through livermore. that will build. that will not clear up. a quick look at the peninsula. palo alto, moves nicely. light volume coming out of the south bay into the city. back to you. is 5:19. a former catholic priest that worked in northern california has been freed from an irish jail. 77-year-old patrick mccabe pleaded guilty to several child abuse charges stemming from the 1970s and '80s in his native ireland. he faced similar charges from at least four people here in california. we are told he worked at the catholic diocese of santa rosa. this weekend, the irish judge freed mccabe 21 months into his

two-year prison sentence citing his age and statement of apology the fbi asking for your help to track down a serial bank robber who has hit banks in pleasanton and walnut creek. he has earned the nicknames button-down bandit. he is believed to be responsible for two bank robberies this past month. investigators say he is between 30 and 35. he wears a button-down long sleeve shirt with dark gray slacks and black dress shoes. in palo alto, a man suspected of robbing and sexually salting a woman he met on line is expected to enter his plea. he is accused of attacking a woman at the glass slipper in on el camino real and charged with attempting to rob a second woman. the coast guard has called off the search for a man who disappeared from roosevelt beach and half moon bay.

> san francisco police say a missing service dog taken from his sleeping owner on a b.a.r.t. train was found yesterday five days after he went missing. an anonymous tip led them to a home in san francisco where they found a small pomeranian. they checked his microchip and

confirmed it was little archy. police interviewed the people in the house and charges are now pending. >> 5:24. boeing says a test flight of its 747 dreamliner went off without a hitch. the plane took off for a two-hour test flight with its redesigned battery system. the dreamliners were grounded in january after a battery caught fire on one plane and started smoking on another. the company has added insulation around battery sells and a steel casing. workers will analyze test data to see how they faired. >> b.a.r.t. riders can expect a longer late-night commute. they are making changes to their schedules on tuesday, wednesday, and thursday after 10:00 p.m. to accommodate construction. the work is expected to go on

good morning. thanks for joining us. i'm laura garcia cannon. >> i'm marla tallez. a deadly crash shuts down part of monterrey road in south san jose. police have been on the scene at monterrey road near tully. bob redell joins us live with the latest. good morning. >> reporter: good morning, marla. it could be another hour and a half before this scene is shut down and reopened for traffic. you can get an idea by looking at the wreckage of how severe this crash was. we believe that was a ford focus. the driver who died here on the scene is still stuck inside. they believe he was speeding on southbound monterrey highway when he lost control around 2:00 this morning. his car clipped two trees and

sheered off a light pole before coming to rest in the bushes outside the el pollo loco. a police officer heard this crash, responded. paramedics showed up and declared the driver dead a short time later. police think they know who he is but they are not releasing his name until they are able to notify his family. he is somewhere in the age range of late 20s, early 30s. there are no obvious signs of drinking and driving but they won't be able to rule that out for certain until toxicology tests. the police department is doing their part in the investigation. it cob another hour, hour and a half before this section of the monterrey highway is reopening. it is shut down in the southbound direction only starting at stouffer until right here where we are at. it is about a block away from tully and kurtner.

the idea maybe this would be reopened by 7:00 this morning. reporting live in south san jose, bob redell, does in the bay. 5:32. in just a few hours, those four in same-sex marriage will be arguing before the highest court in the land. today, the supreme court rather is taking up the matter of california's voter approved ban on same-sex marriage. it has been a long time coming. "today in the bay's" christie smith joins us live in san francisco with more on this really historic event. good morning. >> reporter: good morning to you, laura and marla. the opinion likely won't be issued until june. this is the day so many people have been waiting for when the united states supreme court takes up the issue of same-sex marriage here in the bay area. anticipation is growing. hundreds of marriage equality supports rallying in san francisco at city hall. they are urging the court to rule in favor of marriage

equality as it considers california's ban on same-sex marriage, prop 8. on wednesday, the court will take up the federal defense of marriage act. it covered two city blocks as couples shared stories of their rights that they say have been denied. getting married under then mayor gavin newsom, getting it voided and trying again. many people their moment has finally come. opponents of same-sex marriage says they are waiting to stand up too. >> marriage laws are designed to attach mothers and fathers to each other and to the children that they may create and race in the best environment. >> many bay area couples are already in washington, d.c. just to be on the steps of the supreme court or hoping to hear the historic argument in person saying it really feels like a date with history. also wanted to mention more vigils planned at the state

umbrella. why would they call this area the maze? let's look at it closely. why would we call it the maze? it is the maze of roadways right there on the oakland side of the bay bridge. i've turn td the camera because we are trying to find a couple of reports. no flashing lights and no problems for the flow of traffic. that's at least good news as you experience the area and you are traveling through this portion of oakland and emeryville. no slowing down the east shore freeway either. the two signs at the interchange, reports of debris as they will clarify that when they travel through that portion of 580. this traffic and weather are tied together. bha is going on above the roadway might be settling off the roadway. a quick look outside. we will see how things shape across the bay.

the supreme court is a few hours on hearing the ban on same-sex marriage. people have lined up for days in freezing temperatures just to try to get a part of this historic hearing. "today in the bay's" tracie potts joins us live outside the court where there is a special market for that spot in line, in fact. good morning, tracy. >> reporter: absolutely, laura. with california taking precedence, center stage at the u.s. supreme court, a lot of people really want to hear this case so much so that they spent five days camped outside the court. i talked to some people this morning who were the first in line on one line. they had two separate line. one for people members of the bar and one for members of the public. this woman says she came yesterday and she was given blankets by the homeless, she told me to wrap up, because it was so cold outside. yesterday, we had some snow and then some freezing rain later in

the day. right now, very crowded. demonstrations going on on one side. people have already been let in a while ago within the last hour to try to claim what we think will be only about 50 seats for the public. some are still standing here. a lot of the people are not hoping to go in themselves. they are placeholders. standing out here for days at a time and being paid for it, $30 to $50 an hour to hold a place for someone else who wants to go inside and hear these arguments. people who showed up on thursday, they've already made almost $6,000 standing and sitting and sleeping in the cold for people who want to go inside and hear the historic arguments on prop 8. >> that is something. thank you very much, tracy for the very latest. 5:45. new this morning, the secretary of state, john kerry, is meeting

with afghanistan president, hamid karzai, for a second time on his surprise visit to the country. today's meeting in kabul comes one day after he said he and karzai are on the same page regarding international forces preparing to end combat operations in 2014. kerry is also holding a series of meetings at the american embassy. one is with female entrepreneurs taking part in a u.s.-backed program. some of the women expressed concerns that their rights would deteriorate after u.s. troops leave next year. he is also meeting with civic leaders. it is not all peaceful during his visit. eight suicide bombers have attacked a police headquarters in the eastern part of that country killing five officers and wounding another four. investigators say one attacker hit the police station and another seven stormed the compound. what do we have to prepare for in store for the forecast

nevada lawmakers are considering a bill that would legalize betting on federal elections. backers say this kind of betting is legal in london and gaming companies there are making a fortune. it would allow betting on senate, congressional and presidential campaigns. 5:53. san jose will decide whether to give a silicon valley tech giant millions of dollars in tax incentives to keep them there. they are considering a multimillion-dollar incentive plan for samsung. it would reduce utility taxes and reimburse capital expenses to keep the semi-conductor company from moving to texas. samsung would more than triple its square footage and increase its workforce by a third. san jose major chuck reed says the tax breaks will mean for tax

"today in the bay's" bob redell is live with what police are now saying about potential delays. good morning, bob. good morning to you. it cob another hour before they get monterrey highway open in san jose. it is shut down in the southbound direction, from stouffer to the entrance to the plant shopping center just before the intersection with kurtner and tully. right now, still a little early in the commute. not seeing too much backup. it cob a problem if this goes on past say 7:00. again, right now, it seems like that's when they get this reopened. san jose police are doing their part of the investigation and then they have to have the coroner out to remove the body. this involved a single car, a driver in the red car. we believe it was a ford focus. police tell us at around 2:00 this morning he was heading southbound on monterrey highway when he lost control. his car clipped two trees, sheered off a light pole before coming to rest in the bushes outside the
